DeLay, Nino, and Media Bias?

I never made a diary on the old RedState, but I made this (off topic) comment over at CT, and then it struck me this might could make a good Diary post, so here we go:
The Texas Republican Party has requested an injunction of the 5th circuit's ruling that DeLay must remain on the ballot from the Supreme Court.

but MSNBC makes it sound like the Republicans are going judge shopping, unleashing the scary Scalia Monster to do their bidding (and if he grants the injunction, how then will it be covered? any hunting trips that the left will clamor for recusal over? birthday parties? have they stood in adjacent stalls in the restroom before? gotta be some dirt somewhere!), without once mentioning that Scalia is the one that was asked because he is assigned to be the Circuit Justice for the 5th.
More creation of perception, framing, narrative by the media, or do I protest too much? Granted, its relatively minor, and merely implied (quite subtle for them, really), but given Scalia's near Bush-like ability to drive the left stark raving bonkers, can it really be coincidence? At any rate, we can be assured of how the Kossacks and Keith Olberman and Chris Matthews will react.
UPDATE: just saw a blurb that Scalia rejected the injunction request. So much for that.
